Terms of Service

These Terms of Service (“Terms”) govern your use of Haven Footbag Designer, an app and website by Haven Footbags, operated by Lemonade Sports LLC (“we,” “us”). By using Haven Footbag Designer, you agree to these Terms.

1. The Service

Haven Footbag Designer lets you design custom footbag panel layouts and colors, save your designs to an account, export patterns, and request a handmade footbag made from your design. Some features require a one-time purchase (“Designer Plus”).

2. Your Account

You need an account to save designs and request orders. You’re responsible for keeping your login secure and for anything that happens under your account. You must be at least 13, and old enough to legally agree to these Terms, to create an account. Children under 13 shouldn’t create their own accounts. A parent, guardian or teacher can sign in with their own account and let a child design under it.

3. Your Designs

You own the designs you create. We store them so you can access and edit them, and we won’t use them publicly without your permission. When you request an order, we use your design to quote and make your footbag.

4. Designer Plus

Designer Plus is a one-time purchase, not a subscription. It doesn’t renew or charge you again.

If you buy Designer Plus through the Apple App Store, that purchase is billed and handled by Apple, and Apple’s own terms and refund policies apply. If you buy it on our website, it’s processed by our payment provider, and purchases are generally final except as required by law.

5. Custom Footbag Orders

  • Quote requests are free. Requesting a quote doesn’t commit you to buy anything.
  • Pricing. We review each request and email you a quote with a link to pay on our website. Your order is confirmed only when you pay that invoice.
  • Quotes expire 14 days after we send them if they haven’t been paid.
  • Cancelling. You can cancel a quote request in the app any time before you pay. Once you’ve paid, each footbag is made to order, so contact us about any change or cancellation.
  • Colors. Each footbag is handmade from real fabric. Colors on screen are approximate, and the finished bag may differ slightly from the preview.
  • Returns. You can return a footbag within 30 days of purchase if it’s unused and in its original packaging, including custom orders. If your footbag arrives damaged or has a defect, contact us and we’ll try to repair it first.
  • Payments for orders are processed by our payment provider on our website. We don’t see or store your card details.

6. Acceptable Use

Don’t use Haven Footbag Designer to do anything illegal, to infringe someone else’s rights, or to disrupt or abuse the service.

7. No Warranty

The app and website are provided “as is,” without warranties of any kind. We don’t guarantee they will be error-free or uninterrupted. This doesn’t limit our commitment in section 5 to fix a footbag that arrives damaged or defective.

8. Limitation of Liability

To the extent allowed by law, we aren’t liable for indirect, incidental, or consequential damages arising from your use of Haven Footbag Designer. Our total liability for any claim is limited to the amount you paid us in the past 12 months (or $10 if you haven’t paid us anything).

9. Changes

We may update these Terms occasionally. If we make significant changes, we’ll let you know in the app or on this page. Continuing to use Haven Footbag Designer after a change means you accept the updated Terms.

10. iOS App Store Users

If you downloaded Haven Footbag Designer from the Apple App Store, Apple’s standard licensed application end user license agreement also applies to your use of the app, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

Privacy Policy

This Privacy Policy explains what information Haven Footbag Designer collects and how we use it.

1. What We Collect

  • Account info: your email address, and a display name if you set one.
  • Your designs: the footbag designs and color palettes you create and save.
  • Purchase status: whether you’ve bought Designer Plus, so we can unlock the right features for your account.
  • Order details, if you request a custom footbag: your name, shipping address, phone number (optional), any notes you add, the design and bag options you chose, and the status of your order. We also save a picture of your design and a sewing pattern file to make your footbag.

We don’t collect or store your payment card details. Designer Plus purchases are handled by Apple (App Store purchases) or our payment processor (website purchases), and order payments by our payment processor on our website. We only receive confirmation that a payment happened.

2. How We Use It

We use this information to run your account, save and sync your designs, unlock purchased features, quote, make and ship your custom footbags, keep you updated on your orders by email and in the app, and stay in touch with you, including promotional emails, which you can unsubscribe from anytime.

We don’t share your information with advertising companies, and we don’t track you across other companies’ apps or websites. If that ever changes, we’ll update this policy first.

3. Who We Share It With

We use service providers to run Haven Footbag Designer, and they can access data only as needed to do that:

  • Google Firebase: accounts, design storage, and order images and files.
  • RevenueCat, Stripe and Apple: processing Designer Plus purchases.
  • WooCommerce and WooPayments, on our website hackyhaven.com: managing orders, invoices and order payments, and sending order emails.
  • Shipping carriers: your name and address, to deliver your order.

We don’t share more than what’s needed for these purposes.

Pictures of your design and pattern files for an order are stored at private, hard-to-guess links so they can appear in order emails. Anyone who has one of those links can open it.

4. Your Choices

You can update your account info and delete your designs anytime. You can also permanently delete your account in the app’s Settings screen. This deletes your account and your designs and palettes. We keep records of quote requests and orders you’ve placed or paid for (name, address, order details, the design’s picture and sewing pattern, and payment confirmation) as long as we need them for shipping, customer service, and tax and legal records.

5. Children

Haven Footbag Designer accounts are for people 13 and older. Children under 13 shouldn’t create their own accounts. At home or in a classroom, a parent, guardian or teacher signs in with their own account, and children design under that adult’s account. Designer Teacher lets a teacher turn off quote requests, the only place the app asks for a name, shipping address or phone number, so students don’t enter personal information. We don’t knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, contact us and we’ll delete it.

6. Changes

If we make significant changes to this policy, we’ll let you know in the app or on this page.
